INTRODUCTION

The offer and sale of products is expressly conditioned to these General Terms and Conditions of Sale (hereinafter only ‘T&Cs’). The sales contract stipulated between the Customer and the Seller shall be governed by and interpreted in accordance with Italian Law. The Customer shall, before placing its Purchase Order, carefully read these T&Cs. The placing of a Purchase Order implies full knowledge and express acceptance of both the aforementioned General Terms and Conditions of Sale and of what is requested in the Order Form. The Customer is obliged, once the purchase procedure has been completed, to keep these general conditions of sale and the relative Order Form, already viewed and accepted.

CONCLUSION OF CONTRACT

1. The contract between the Seller and the Customer shall be deemed concluded with the acceptance, even partial, by GOBBISPORT, which reserves the right, at its sole discretion, to accept it. Acceptance shall be deemed tacit unless otherwise communicated in any manner to the Customer. By placing an Order, the Customer declares that he/she has read all the information provided during the purchase process and fully accepts the T&Cs.

2. Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an Order.

3. The Customer is prohibited from entering false, and/or invented, and/or fictitious names in the on-line Order procedure and further communications. The Seller reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.

4. By accepting these T&Cs, moreover, the Customer exonerates the Seller from any liability arising from the issuance of erroneous tax documents due to errors relating to the data provided at the time of placing the on-line Order, the Customer himself being solely responsible for their correct entry.

PURCHASE PROCEDURE

1.The Customer may order the products in the GOBBISPORT electronic catalogue as described in the respective information sheets. The pictures accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, but may differ in colour, dimensions, accessory products in the picture. All purchase support information (technical information, purchase guide, etc.) is to be understood as mere generic information material, not referring to the real characteristics of a single product, and does not in any way constitute technical advice.
2. In order to conclude the contract for the purchase of one or more products on the Site, the user must fill in an Order Form in electronic format, following the instructions that will appear from time to time on the Site and that will accompany the different stages of the purchase:

• selection of the products to be purchased
• registration as a new user of the Site or access as an already registered user
• indication of delivery address, selection of type of delivery/shipping
• selection of payment method
• data confirmation and order submission

Before proceeding with the transmission of the Order, the Customer will be asked to confirm that he/she has read the General Conditions and will be able to identify and correct any typo errors. The languages available to conclude the contract with the Seller are Italian, English and German.

3.The Order shall be automatically transmitted to the Seller upon completion of the purchase process. Once the order form has been registered and the correctness of the order and payment data has been verified, the contract is deemed to be concluded and the Seller will send a confirmation e-mail to the Customer's e-mail address containing information about the purchased product, a detailed indication of the price, the means of payment used, the shipping costs and any additional costs. It is recommended to keep the e-mail received as proof of purchase or to store it on a durable medium.

4.The order form will be stored in the Seller's database in accordance with the law. In order to access their Order form, the Customers has access to the ‘User area - Order list’ section of the website, where they will find the list of all the Orders placed.

5. Products sold on the site can only be purchased and delivered in the countries indicated in the Order Form. Any Orders for shipments to be made outside these countries will be automatically rejected during the Order processing procedure.

ORDER PROCEDURE

1. Orders will be dispatched as soon as the Seller receives payment (purchase price and any shipping costs). GOBBISPORT therefore invites the customer to pay the price as soon as it receives the order confirmation and in any case within the following 24 hours.

2. The Seller may not process purchase orders that do not provide sufficient guarantees of solvency or in case of unavailability of products. In these cases, the Customer shall be informed by e-mail that the contract is NOT concluded. Payments already received will be refunded immediately (i.e. within seven days of cancellation) by the retailer via the payment method indicated by the customer. In the event of cancellation by the reseller, the customer shall bear no costs.

3. The reseller undertakes to deliver the ordered products to the customer no later than 30 days after conclusion of the contract. In the event that the Seller is unable to deliver the product within the agreed term, the Customer is entitled to termination of the sales contract and a refund.

4. GOBBISPORT reserves the right to reject orders from a customer with whom a legal dispute relating to a previous order is pending. This applies equally to all cases in which GOBBISPORT considers the Customer to be unsuitable, including, but not limited to, the case of previous violations of terms and conditions for online purchases on the Website or for any other legitimate reason, especially if the Customer has been involved in fraudulent activities of any kind.

SALE PRICES

1. Unless otherwise specified in writing, all prices of the Products and shipping and delivery charges indicated on the website and in the Order are to be considered VAT included and expressed in Euros. The validity of the prices indicated is always and only that indicated on the website at the time the Order is transmitted through the Internet. The prices of the Products and shipping and delivery charges may vary without prior notice.

2. All Products are shipped directly from Italy. The prices of the Products and of the shipping and delivery charges indicated on the web site and in the Order, unless otherwise specified, are not inclusive of possible costs related to customs duties and relevant taxes, which cannot be calculated in advance, if the shipment takes place in non-EU countries or in countries where import charges are provided for by the applicable regulations. In this hypothesis, the existence of any additional costs indicated above will be clearly mentioned when placing and reviewing the Order. These costs are therefore borne by the Customer and shall be paid directly upon delivery of the Products, according to the indications specified in the Order Confirmation.
